By accessing and using Build360View's website, mobile applications, and related services (collectively, the 'Services'), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ('Terms'). These Terms constitute a legally binding agreement between you and Build360View. If you disagree with any part of these Terms, you must not access or use our Services. Your continued use of the Services following the posting of revised Terms means that you accept and agree to the changes. If you are using our Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

Use License and Restrictions

Subject to your compliance with these Terms, Build360View grants you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for personal or internal business purposes.

Permitted Uses

  • Access and use our tools, calculators, and resources for legitimate construction and planning purposes
  • View, download, and print content for personal reference
  • Share links to our publicly available content
  • Subscribe to newsletters and updates

Prohibited Activities

  • Modify, copy, distribute, transmit, display, perform, reproduce, publish, license, or create derivative works from any content without authorization
  • Use the materials for any commercial purpose without explicit permission
  • Attempt to decompile, reverse engineer, or disassemble any software or technology
  • Remove, obscure, or alter any copyright, trademark, or proprietary rights notices
  • Use any automated systems (bots, scrapers, robots) to access the Services
  • Interfere with or disrupt the Services or servers
  • Impersonate any person or entity, or falsely claim affiliation
  • Collect or harvest any information about other users
  • Upload or transmit viruses, malware, or malicious code

User Accounts and Responsibilities

To access certain features of our Services, you may be required to create an account. You agree to:

  • Maintain and promptly update your account information to keep it accurate
  • Maintain the security and confidentiality of your account credentials
  • Notify us immediately of any unauthorized access or security breaches

We reserve the right to suspend or terminate accounts that violate these Terms or engage in suspicious or fraudulent activity. You are solely responsible for any consequences resulting from unauthorized use of your account.

You may not create multiple accounts, especially if a previous account was suspended or terminated.

 

Intellectual Property Rights

All content, features, and functionality available through our Services, including but not limited to text, graphics, logos, images, videos, audio, software, data compilations, and the overall look and feel of the Services, are owned by Build360View, its licensors, or other content providers.

This content is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

What You Can Do

  • View and use content for personal, non-commercial purposes
  • Share links to our content on social media and other platforms
  • Quote brief excerpts with proper attribution
 

What You Cannot Do

  • Reproduce, distribute, or create derivative works without permission
  • Use our content for commercial purposes without a license
  • Remove or modify any proprietary notices or attributions

User-Generated Content

Our Services may allow you to submit, post, or share content such as comments, reviews, forum posts, images, or other materials (‘User Content’). By submitting User Content, you:

  • Grant Build360View a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display your User Content
  • Represent and warrant that you own or have necessary rights to the User Content
  • Agree that your User Content does not violate any third-party rights
  • Acknowledge that we may use your User Content for promotional purposes
  • Understand that we have the right (but not obligation) to monitor, edit, or remove any User Content

You retain all ownership rights to your User Content. However, you acknowledge that we need these broad rights to operate and promote our Services effectively.

We are not responsible for User Content posted by others. If you believe any User Content violates your rights or these Terms, please contact us immediately.

Prohibited Conduct

You agree not to use our Services in any way that:

Disclaimer of Warranties

  • The Services are provided on an ‘AS IS’ and ‘AS AVAILABLE’ basis without warranties of any kind
  • We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement
  • We do not warrant that the Services will be uninterrupted, secure, error-free, or virus-free
  • We make no warranties about the accuracy, completeness, or reliability of any content

Limitation of Liability

  • To the maximum extent permitted by law, Build360View and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • This includes damages for loss of profits, revenue, data, or other intangible losses
  • Our total liability shall not exceed the amount you paid to us in the twelve months preceding the claim
